Do I need an attorney?

car was damaged in the accident. Does the other driver’s
insurance company have to replace it?
Under Virginia law the at-fault driver is responsible for the lesser of
the cost to repair the property damage or the fair-market value of a vehicle
which
is a total loss. Unfortunately, automobiles tend to depreciate rapidly, often
faster than the loan on them is paid down. So the value of the automobile
(which is what the insurance company must pay) may be less than the balance
due on
the loan.
