Five more states are being granted waivers from the Bush-era No Child Left Behin

An Obama administration official says Arkansas, Missouri, South Dakota, Utah and Virginia will be granted relief from key requirements of the law. Twenty-four states now have been approved for waivers.
Democrats and Republicans in Congress agree the law needs to be fixed but can't agree on how. The law requires all students be proficient in math and reading by 2014, a goal the nation remains far from reaching. As that deadline approaches, an increasing number of schools have been labeled "failing."
The waivers allow states to develop their own accountability plans, focusing on preparing students for college and improving teacher effectiveness and school performance.
The official spoke on condition of anonymity before Friday's announcement.

Their decisions come after pouring over intelligence that's flooding in from crew leaders, weather forecasters and fuels analysts.
Elsewhere, teams of specialists smooth out the logistics of shuffling firefighters and equipment around the country.
Tom Harbour is the director of fire and aviation management for the U.S. Forest Service.
He says that the characterization that fire is war is probably a fitting one.
But he expresses cautious confidence that the Forest Service has adequate resources to do the job.

Flight attendant loses cool aboard NYC plane

NEW YORK (AP) - A flight attendant on a weather-delayed plane at LaGuardia Airport yelled at passengers and challenged them to leave the plane if they dared.
The incident involving American Eagle flight attendant Jose Serrano was caught on video. Flight 4607 to Raleigh-Durham, N.C., was delayed for five hours on Monday.
Port Authority police were called to the plane.
American Airlines apologized for the incident. It said in a statement it did "not believe that the passengers' frustrations were always met with the level of service that we expect from our people."
Serrano was removed from the plane. There were no arrests.
The incident recalled a similar episode involving a Jet Blue attendant last year who swore at passengers and pulled the emergency chute on a flight after it landed at Kennedy Airport.

Court upholds individual mandate in health care law

WASHINGTON (AP) - The individual mandate survives.
The Supreme Court has upheld the heart of President Barack Obama's health care overhaul -- ruling in favor of the requirement that most Americans can be required to have health insurance, or else pay a penalty.
The decision means the historic overhaul will continue to take effect over the next several years, affecting the way countless Americans receive and pay for their personal medical care.
The ruling also hands President Barack Obama a campaign-season victory.
The court found problems with the law's expansion of Medicaid. But even there, it said the expansion could proceed as long as the federal government does not threaten to withhold the entire Medicaid allotment to states if they don't take part in the extension.
The court's four liberal justices, Stephen Breyer, Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor, joined Roberts in the outcome.

ATLANTA (AP) - Rielle Hunter says she's sorry for any pain that her relationship with former presidential candidate John Edwards caused his late wife Elizabeth and others.
Hunter told CNN's Piers Morgan on Wednesday, "I am sorry, I am absolutely sorry for my part in the relationship - having an affair, any pain it caused anyone including Elizabeth."
Hunter is promoting a new book, "What Really Happened: John Edwards, Our Daughter and Me." She recently revealed that she and Edwards had ended their relationship.
In the book, Hunter describes intimate details about her affair with Edwards, whose campaign hired her as a videographer, and sheds light on his thoughts as federal prosecutors mounted a case against him on illegal campaign contribution charges.
Hunter said she didn't want to discuss her conversations with Edwards about the book, which she said he refused to read before publication. Hunter said their relationship produced "a great gift," their 4-year-old daughter, Quinn.

NEW YORK (AP) - Plans for the brother of jailed financier Bernard Madoff to plead guilty and serve 10 years in prison are raising new questions about the status of the investigation into the epic multibillion dollar fraud and whether other family members remain under criminal investigation.
U.S. prosecutors notified a judge and victims Wednesday that Peter Madoff will plead guilty Friday to conspiracy and falsifying records charges more than three years after his brother began serving a 150-year sentence for creating the fraudulent multibillion dollar private investment business.
Bernard Madoff claimed that he acted alone in enticing thousands of investors over several decades to join what became the largest Ponzi scheme ever prosecuted in U.S. history.
Peter Madoff was the former chief compliance officer at the private investment arm of Bernard Madoff's business.

Man who chewed on other's face not on 'bath salts'

MIAMI (AP) - Authorities may never know why a Florida man viciously attacked and chewed on the face of an older homeless man in Miami after lab tests failed to find components of "bath salts" in the system of the assailant, who was killed by police.
The medical examiner says the tests detected only marijuana in the system of the attacker, ruling out other street drugs that some had speculated Rudy Eugene might have taken.
Lab results also didn't find alcohol or prescription drugs.
Surveillance video captured 65-year-old Ronald Poppo being attacked by Eugene on May 26. A police officer shot and killed Eugene, who bit into Poppo's face in broad daylight alongside a busy highway. Police have not released a motive for the attack.
Poppo has undergone several surgeries and remains hospitalized.

Colorado wildfire prompts partial evacuation at Air Force Academy

COLORADO SPRINGS, Colo. (AP) - Air Force Academy officials are evacuating some homes on school grounds as heavy smoke billows from a wildfire north of Colorado Springs.
The part of the academy housing cadets wasn't immediately evacuated. A new class of cadets is scheduled to report on Thursday.
A fire official said earlier Tuesday that the blaze was less than 5 miles from the southwest corner of the academy's campus.
Meanwhile, authorities in central Utah found one woman dead Tuesday when they returned to an evacuated area. It marks the first casualty in a blaze that consumed at least two dozen homes and appears to be taking a turn for the worst.
Throughout the interior West, firefighters toiled in searing, record-setting 100 degree heat as they struggled to contain blazes in Colorado, Utah and other Rocky Mountain states.

Adult chimpanzee kills baby chimp at LA Zoo

LOS ANGELES (AP) - Officials at the Los Angeles Zoo say a baby chimpanzee was killed by an adult male chimpanzee inside their exhibit as visitors watched.
Zoo spokesman Jason Jacobs said in a statement that visitors told officials the 3-month-old infant chimp was attacked Tuesday. Jacobs says workers could not stop the attack because it is not safe for them to occupy the same space as the chimpanzees.
The baby's mother, a chimp named Gracie who gave birth on March 6, is allowed to keep the body overnight to grieve.
Jacobs says the infant was being gradually introduced to the troop, and there had been no indication of aggressive behavior toward her. But the zoo's statement says chimpanzee behavior can "sometimes be aggressive and violent."
The zoo apologized to visitors who witnessed it.

House rejects bid to slash rural airline subsidies

WASHINGTON (AP) - The House has turned back an attempt by a tea party-backed GOP conservative to slash taxpayer subsidies for air service to isolated smaller cities and towns that can cost hundreds of dollars a ticket.
Tuesday's vote killed a bid by Rep. Tom McClintock, R-Calif., to slash the Essential Air Service program, which subsidizes flights to 120 communities in 35 states in the continental U.S. and Puerto Rico and 43 towns in Alaska.
The vote came as the House debated a $107 billion transportation spending bill for the budget year beginning Oct. 1.
Republicans controlling the House had voted to eliminate the oft-criticized program last year while they considered renewing federal aviation programs, but a coalition of Democrats and Republicans representing rural America reversed the move in the Senate.

Debby Makes Landfall in Florida Tuesday

ST. GEORGE ISLAND, Fla. (AP) - Tropical Storm Debby has made landfall on the northwest coast of Florida.
The National Hurricane Center said Tuesday afternoon that Debby made landfall near Steinhatchee with top winds of 40 mph.
Debby is expected to weaken to a tropical depression Tuesday night.
Debby has drenched Florida for four straight days and forecasters warn that even though the storm is weakening, the threat of flooding remains.
The deluge has spoiled vacations for many visitors.

Bodies of suspected immigrants found in AZ desert

TUCSON, Ariz. (AP) - Border Patrol agents say the bodies of three suspected illegal immigrants have been recovered in southern Arizona.
Authorities say the three likely died from exposure to the triple-digit desert temperatures.
Agents say the three victims were found in separate incidents Saturday.
Casa Grande Station agents working near Sells located a pregnant female sitting with her deceased husband. The Guatemalan couple had crossed the border two days earlier and had been abandoned by their smuggler when the husband collapsed.
Later in the day, agents from the Tucson Sector located the remains of a man near Queens Well who appeared to be in his 70s.
Ajo Station agents on Saturday night located another deceased man northwest of Lukeville. The man in his 30s was naked in an apparent attempt to cool down.

6 arrested in Oregon Capitol protest over logging

SALEM, Ore. (AP) - Six people have been arrested in a demonstration at the Oregon state Capitol.
Two of the demonstrators climbed flag poles Monday and attached homemade banners protesting plans to increase logging on state land.
The others were arrested more than three hours after they chained themselves together Monday in the offices of Secretary of State Kate Brown and State Treasurer Ted Wheeler.
Several dozen other demonstrators remained in the building throughout the day, singing songs that echoed through the building.
Wheeler, Brown and Gov. John Kitzhaber make up the State Land Board, which angered environmentalists last year with a plan to increase logging in the Elliott State Forest.
The timber industry has said the plan will create new jobs and boost school funding, but conservation groups say it would harm fish and wildlife.

Key figure in prostitution ring to enter plea

ALEXANDRIA, Va. (AP) - An alleged street gang member accused of running a prostitution ring that recruited high school girls is set to enter a plea.
Federal prosecutors say Justin Strom, of Lorton, is due in U.S. District Court in Alexandria on Tuesday for a plea hearing.
Prosecutors say Strom was the leader of a street gang that threatened girls if they refused to participate in the prostitution ring.
He was charged along with four other men. Prosecutors say the other defendants have pleaded guilty.
According to an FBI affidavit, the defendants are members of a Fairfax-based offshoot of the Crips street gang known as the Underground Gangster Crips.

NEW YORK (AP) - A man charged with plotting to blow up synagogues in New York is due to learn whether a judge will let the unusual state-level terror case go forward.
Ahmed Ferhani was due in court Monday. A judge is expected to rule on his request to dismiss the case.
His lawyers say it's based on insufficient evidence and dubious police tactics. The Manhattan district attorney's office says Ferhani was intent on attacking a synagogue and bought three guns and a grenade to do so. The buy was a sting.
Ferhani and co-defendant Mohamed Mamdouh were arrested last year. They've pleaded not guilty.
A grand jury declined to indict them on a top-level terror conspiracy charge. They still face other terror and hate crime charges that carry up to 32 years in prison.

Vicious wildfires spread to Colo. tourist centers

COLORADO SPRINGS, Colo. (AP) - Authorities say the total number of homes destroyed by a fire that's been burning in northern Colorado for two weeks is now 248.
Fire officials told residents of the Glacier View subdivision that at least 57 more homes in their neighborhood have been lost.
The confirmed count previously was 191 homes, already a Colorado record.
Fire incident team spokeswoman Reghan Cloudman tells the newspaper that 1,200 of the 4,300 homeowners evacuated from the path of High Park fire were allowed to return to their properties Sunday.
The wildfire near Fort Collins has scorched more than 118 square miles. It is one of eight now burning in the state.
One of those fires erupted near Colorado Springs on Saturday, causing about 11,000 people to leave their homes.
Authorities said Sunday that they were allowing about 5,000 of those residents to return.

Suspect dead, 6 wounded in Ky. shootings

HAZARD, Ky. (AP) - Kentucky State Police say a gunman is dead and others wounded after the suspect opened fire on a vehicle and continued shooting when law enforcement arrived.
Trooper Jody Sims says the two deputies and a trooper who were shot Sunday didn't have life-threatening wounds. The two people in the vehicle also weren't hurt seriously.
State Trooper Tony Watts says the suspect was shot and later pronounced dead at a hospital.
Sims says a motorist driving through the mountainous area in the eastern part of the state called authorities around 8 p.m. to say someone was shooting at the vehicle.
Two troopers and two deputies then arrived and came under fire. One of the troopers was shot in the face, but was expected to recover.
Investigators were still at the scene early Monday.

Sandusky Found Guilty

BELLEFONTE, Pa. (AP) - Joe Paterno's family says the "healing is just beginning" but that Jerry Sandusky's conviction on 45 counts in his sex abuse trial is "an important milestone."
The family of the late Hall of Fame coach released a statement, saying their hearts and prayers are with the victims and their families. They thanked the jurors and said the community "owes a measure of gratitude" to them.
Sandusky was convicted Friday of sexually assaulting 10 boys over 15 years. The accusations had led to the firing of Paterno, Penn State's beloved coach who died of lung cancer Jan. 22.
Penn State's Board of Trustees ousted Paterno for what was called his "failure of leadership" surrounding allegations about Sandusky.

Mount Rainier ranger killed in climbers' rescue

LONGMIRE, Wash. (AP) - A Mount Rainier climbing ranger has died during efforts to rescue four injured climbers from Waco, Texas.
Mount Rainier National Park spokesman Kevin Bacher (BAA-ker) says 34-year-old Nick Hall fell 3,000 feet Thursday from the 13,700-foot level of the 14,411-foot mountain. He was dead when other rangers reached him several hours later.
A helicopter plucked two of the injured climbers off the mountain Thursday night while two others were waiting out a worsening storm overnight with the aid of park rangers.
The Texas party includes two men and two women. Bacher says all four have non-life-threatening injuries. None was immediately identified.
The climbers were roped together when they fell on Emmons Glacier. The two women at the end of the rope ended up in a crevasse. Rangers who responded to a cell phone call helped them out of the crevasse.

Man, 75, gets life in tow truck driver's killing

ATLANTA (AP) - A 75-year-old Atlanta man has been convicted of murder and sentenced to life in prison in the February, 2011 shooting death of a tow truck driver.
The Fulton County district attorney's office says a jury on Thursday convicted Philmore Reed of murder and other offenses in the death of Travis Fenty, an employee of Quick Drop Towing. Superior Court Judge Jerry Baxter sentenced Reed to life plus five years in prison.
Fenty and a colleague were attempting to tow Reed's unauthorized vehicles from a parking lot when Reed opened fire with a shotgun from a nearby rooftop, striking Fenty in the chest. Reed later surrendered to police who had surrounded the building. He told detectives, "With all this stuff going on about my property, I have no remorse.".

AMARILLO, Texas (AP) - Federal prosecutors will begin presenting their case against a Saudi man accused of gathering bomb components in his West Texas apartment with the goal of targeting sites across the United States.
Khalid Ali-M Aldawsari, 22, faces up to life in prison if convicted of attempted use of a weapon of mass destruction. Targets he allegedly researched included the Dallas home of former President George W. Bush, dams and nuclear plants.
Opening statements are set for Friday morning in Amarillo. Aldawsari, a former Texas Tech University chemical engineering student, has pleaded not guilty.
A jury of eight women and six men was selected Thursday; the panel includes two alternates.
Court records show Aldawsari's attorneys plan to use an insanity defense.

BELLEFONTE, Pa. (AP) - A lawyer for a son of Jerry Sandusky says the man has told authorities the former Penn State assistant football coach abused him.
Matt Sandusky is one of Jerry Sandusky's six adopted children.
His lawyer issued a statement Thursday naming Matt Sandusky and saying that the 33-year-old had been prepared to testify on behalf of prosecutors at his father's sex abuse trial.
The statement says Matt Sandusky is "a victim of Jerry Sandusky's abuse," but doesn't go into specifics.
The statement came after jurors began deliberating 48 charges against the ex-coach. Prosecutors say Sandusky met the 10 sex-abuse victims through his charity.
Lawyers for Matt Sandusky and prosecutors did not immediately respond to requests for comment. Karl Rominger, one of Jerry Sandusky's lawyers, did not comment.
Matt Sandusky's lawyer says his client met with investigators very recently.

LUBBOCK, Texas (AP) - Jury selection is set to begin in the federal trial of a Saudi man accused of gathering bomb components with the intention of targeting sites across the U.S. including former President George W. Bush's Dallas home.
Khalid Ali-M Aldawsari, 22, a former Texas Tech University chemical engineering student, faces up to life in prison if convicted of attempted use of a weapon of mass destruction.
Prior to Aldawsari's Feb. 23, 2011, arrest, federal agents secretly searched his West Texas apartment, where they say they found bomb-making chemicals as well as beakers, flasks, wiring, a hazmat suit and clocks.
He has pleaded not guilty. Court records show attorneys plan to use an insanity defense.

Obama faces growing GOP super PAC financial power

WASHINGTON (AP) - The latest financial filings for the presidential campaign show that the "super" political committees supporting GOP candidate Mitt Romney and his party are widening the money gap over pro-Democratic Party organizations.
The main pro-Romney super PAC, Restore Our Future, reports raising $8 million in May, giving it a total of $64 million so far.
A political committee backing Obama, Priorities USA Action, posted its strongest one-month total by raking in $4 million in May.
But the pro-Obama group is still being left in the dust - in part by the latest tally from a Republican super PAC formed by GOP strategist Karl Rove, American Crossroads. It raised $4.6 million in May.
The changing calculus raises the prospect that Obama could become the first incumbent president outspent by his challenger.

SANFORD, Fla. (AP) - Saying he's lost the trust of officials, a city manager fired a central Florida police chief who was criticized for his agency's initial investigation of Trayvon Martin's shooting death at the hands of a neighborhood watch volunteer.
Sanford City Manager Norton Bonaparte says in a Wednesday statement that he relieved Chief Bill Lee of duty because he "determined the Police Chief needs to have the trust and respect of the elected officials and the confidence of the entire community."
The initial lack of an arrest following the death of the unarmed black teenager by neighborhood watch volunteer George Zimmerman in February led to protests across the nation and spurred a debate about race and the laws of self-defense. Zimmerman's father is white and his mother is from Peru.

They said early Monday that the 68-year-old Bryson was treated at a hospital for non-life-threatening injuries following the crashes around 5 p.m. PDT Saturday.
The Los Angeles County Sheriff's department and the San Gabriel Police Department say he was driving alone on a major street in San Gabriel when he allegedly struck the rear end of a vehicle, then left the scene after speaking briefly with the occupants.
The agencies say minutes later he struck another vehicle in a nearby community, and police arriving found him unconscious behind the wheel of his car.
San Gabriel Police spokesman Lt. Ariel Duran says Bryson was cited for felony hit-and-run, and prosecutors will determine later if he'll be formally charged.

FAYETTEVILLE, Ga. (AP) - Megachurch pastor Creflo Dollar has been arrested after authorities say he slightly hurt his 15-year-old daughter in a fight at his metro Atlanta home.
Fayette County Sheriff's Office investigator Brent Rowan says deputies responded to a call of domestic violence at the home around 1 a.m. Friday.
Rowan says the 50-year-old pastor and his daughter were arguing over whether she could go to a party when Dollar "got physical" with her, leaving her with "superficial injuries."
Dollar faces misdemeanor charges of simple battery and cruelty to children. He bonded out of Fayette County jail Friday morning. Dollar's lawyer Nikki Bonner said he's gathering information on the case and had no comment.
Dollar is the pastor for World Changers Church International in College Park. A spokeswoman for the church did not immediately return a call seeking comment.

WASHINGTON (AP) - A federal appeals court has thrown out a rule that allows nuclear power plants to store radioactive waste at reactor sites for up to 60 years after a plant shuts down.
The appeals court, in a unanimous ruling Friday, said the Nuclear Regulatory Commission did not fully evaluate the risks associated with long-term storage of waste. The court said on-site storage has been "optimistically labeled" as temporary, but has stretched on for decades.
The Obama administration has cut off funding for a proposed nuclear waste dump in Nevada, but has not identified an alternative site.
The appeals court said the NRC should complete a detailed environmental review of on-site storage or explain why one is not needed.
The lawsuit was filed by four Northeastern states, led by New York.

OAKLAND, Calif. (AP) - Retail giant Costco will pay $3.6 million for alleged environmental violations under a settlement with the district attorneys of more than two dozen California counties.
A Northern California judge approved the settlement Friday. It stems from a civil case brought by the district attorneys, who alleged Costco violated state laws for the safe storage, handling and disposal of hazardous waste, including pharmaceutical waste.
Prosecutors say the violations first came to light in San Joaquin County, but occurred from 2007 to 2012 at Costco stores and distribution centers across the state.
The $3.6 million settlement includes civil penalties, costs and funds for environmental projects.
Prosecutors say Costco officials were cooperative and quickly came into compliance with regulations.
A call to the company Monday wasn't immediately returned.

WASHINGTON (AP) - The Supreme Court won't stop prosecutors from going after four Blackwater Worldwide guards involved in a 2007 shooting that killed 17 Iraqis.
The high court on Monday refused to hear an appeal from Evan Liberty, Donald Ball, Dustin Heard and Paul Slough.
A federal judge threw out the case, saying the Justice Department mishandled evidence and violated the guards' rights. But the U.S. Court of Appeals for the District of Columbia Circuit reinstated the charges.
The court refused to reconsider that decision without comment.
Blackwater security contractors are accused of opening fire in a crowded Baghdad intersection in 2007. Seventeen people were killed and 20 others wounded. Prosecutors said the shooting was unprovoked.
North Carolina-based Blackwater renamed itself Xe Services after the shooting.
